
State Sen. Sabrina Cervantes of California will not be facing DUI charges following a collision in Sacramento, as a recent drug test revealed she was not under the influence at the time of the incident.
The Sacramento County District Attorney’s Office made the announcement on Friday, stating that the blood test taken by the Riverside County Democrat on the day of the accident near the Capitol showed no measurable amount of alcohol or drugs.
Review of Evidence
After evaluating all the evidence submitted, including police reports, witness statements, and laboratory results, the DA’s office concluded that there was insufficient basis to pursue criminal charges. The office emphasized its ethical responsibility and the high burden of proof required in a criminal trial.
Following the collision on May 19, where Cervantes went to the hospital, Sacramento police cited her for a DUI. However, she vehemently denied any intoxication allegations, claiming mistreatment by the police during her hospital visit.
Subsequent investigations by the police suggested that Cervantes might have been under the influence of drugs rather than alcohol when the citation was issued. In response, Cervantes provided the results of a urine test conducted the day after the accident, which indicated no detectable levels of drugs in her system.
Earlier statements from the DA’s office had indicated that the decision on whether to prosecute Cervantes would depend on the results of the blood test.
