FBI Director Kash Patel’s recent announcement of a judge’s arrest over an immigration dispute has brought to light a significant development in the ongoing power struggle between the Trump administration and the judiciary. This incident bears striking similarities to a case that unfolded during President Donald Trump’s first term in office.
Reflecting on Past Events
Back in 2018, Massachusetts state District Court Judge Shelley Joseph and a court officer faced accusations of aiding an undocumented migrant’s escape from the Newton District Court in Massachusetts before Immigration and Customs Enforcement could apprehend him. The individual in question had a history of narcotics-related charges and had been deported from the U.S. on two previous occasions, as per prosecutors’ statements at the time.
Subsequently, Joseph was indicted by federal prosecutors on charges of conspiracy to obstruct justice and obstruction of justice. She maintained her innocence throughout the legal proceedings.
Legal and Political Backlash
During Joseph’s indictment, then-state Attorney General Maura Healey, who now serves as the Democratic governor of Massachusetts, condemned the situation as a “radical and politically motivated attack on our state and the independence of our courts.”
Joseph’s attorney, Thomas Hoopes, raised allegations of political bias against then-U.S. Attorney for Massachusetts Andrew Lelling, citing a Boston Herald op-ed penned by Lelling and accusing him of leaking confidential information to the press.
Unlike the recent case, Joseph voluntarily surrendered to authorities. Ultimately, federal prosecutors dismissed the charges against her in 2022, redirecting the matter to the Massachusetts Commission on Judicial Conduct for further investigation.
Continued Legal Action
In a surprising move late last year, the Commission filed formal charges against Joseph with the state’s highest court, marking a rare step for the agency, which had taken similar actions only a handful of times since the turn of the century.
In the present day, Wisconsin judge Hannah Dugan faces felony charges of obstruction and harboring a person from arrest. Dugan stands accused of assisting an undocumented immigrant in evading law enforcement by redirecting agents away from her courtroom and facilitating the individual’s departure through a private exit.
Political Critique
Democratic Wisconsin Governor Tony Evers condemned the Trump administration for its perceived attempts to undermine the judiciary on multiple fronts, including disregarding court rulings and threatening judges who did not rule in alignment with the administration’s interests.
