
Federal Judge Rules Against Military Ban
A federal judge has issued a ruling that prevents the Pentagon from enforcing President Trump’s order to ban transgender individuals from serving in the military. The judge described the ban as being ‘soaked in animus’ and unconstitutional discrimination based on sex.
In her 79-page opinion, U.S. District Judge Ana Reyes highlighted the sacrifices made by transgender servicemembers and criticized the administration for mischaracterizing medical studies to justify the ban. She noted that the administration had misrepresented research on transgender individuals and overlooked data supporting their ability to serve in the military.
Deference to Military Not Blind
Judge Reyes, a Biden appointee, acknowledged the importance of giving deference to the military on matters of troop readiness and lethality. However, she emphasized that such deference should not be ‘blind’ when constitutional violations are present. She delayed the implementation of her order until March 21 to allow the Trump administration to seek an emergency appeal.
